RESOLUTION
Pursuant
to previous notice, 50 representative members of the Fort Berthold Reservation
officially known as the Three Affiliated Tribes in council assembled, and held
in the Community Hall at Elbowoods, North Dakota, on November 3, A. D. 1951.
James
Holding Eagle offered prayer.
Justin
Spotted Bear, Chairman.
Quorum
being present.
The
Chairman called the meeting to order, and announced that the house was open for
any business properly presented and anticipated by the Three Affiliated Tribes.
Victor
Young Bear introduced a resolution and interpreted contents of said resolution.
Davis Painte was
called, and a full interpretation of the aforementioned resolution given in his
language of the Arikara people, and the Three Affiliated Tribes adopted the
resolution and passed upon record the following declaration:
WHEREAS,
the Tribal Council of the Three Affiliated Tribes of the
Fort
Berthold Reservation may authorize payments out of any available port- ion of
the foregoing $7,500,000 for the per capita interest of any tribal member in
Tribal assets in consideration for the relinquishment by said member in behalf
of himself, his heirs, or assigns of all claims to any future rights income and
assets.
RESOLVED,
by the three tribes, to-wit; the Gros Ventre, Mandan, and Arikara people, That
the above quoted 4th paragraph of the Four Point Tribal Council resolution in
Act signed and approved by the Secretary of the Interior which had become
inconsistent with this resolution and hereby amended by the Three Affiliated
Tribes and activated to read as follows:
BE
IT FURTHER RESOLVED, that the Tribal Council of the Fort Berthold
Reservation
shall authorize per capita payment of their prorate share plus interest to each
enrolled member of the Fort Berthold Reservation out of any available portion of
the foregoing $7,500,000.
BE
IT THEREFORE FURTHER RESOLVED, That other important and pertinent
matters
hereto incorporated in the following sections of this Resolution
Section
I. The remainder of more or less residual of 450,000 acres of the Fort Berthold
Reservation shall hereafter remain forever non-taxation in accordance to supreme
law of the United States that 'Reads: "That at the beginning and for
indefinite time into the future, the American Indians paid their land tax.
Indian tribes surrendered large areas of land in exchange for smaller areas plus
immunity from the land tax and exemption from the sovereignty of local political
subdivisions.”
Section
II. That mineral rights above and below the surface
bf
the lands, including the inundations of the Garrison Dam, to be held and
retained forever by the Three Affiliated Tribes of the Fort Berthold
Reservation, State of North Dakota.
Section III. That language portion
of the Tribal Council resolution worded as follows: "For the per capita
interest of any tri- bal member in Tribal assets in consideration for the
relinquishment by said member in behalf of himself, his heirs or assigns of all
claims to any future Tribal rights income or assets." Hereby stricken out
by vote of the Three Affiliated Tribes of the Fort Berthold Reservation, State
of North Dakota.
THEREFORE
BE IT FURTHER RESOLVED, That the Tribal Council, the Commissioner of Indian
Affairs, North Dakota delegation in the Senate and the House of Representatives
and all interested people be advised of the above decision for their approval
hereto incorporated in this resolution.
In
